Timechief Terms of Service:

Timechief and John Morrice Developer ("we," "our," or "us") operate and provide access to the Hands smart clock ("Device") and its associated cloud service ("Service"). By using the Device and Service, you agree to comply with and be bound by these Terms of Service ("Terms").


1. Introduction

These Terms govern your use of the Hands smart clock, which runs on a Raspberry Pi, and the cloud-based services we provide in conjunction with Google’s APIs. Our Service integrates with Google Calendar and related Google APIs to retrieve calendar data and display it on your Device.

By using or accessing our Service, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, please discontinue use of the Device and Service immediately.


2. Eligibility

You must be at least the age of majority in your country of residence (or have parent/guardian consent) to use the Service. By using the Service, you represent and warrant that you meet these requirements.


3. Accounts & Google Services Integration

3.1 Google API Usage

If you choose to link your Google account to our Service, you agree to adhere to Google's own applicable terms and policies, including the Google Terms of Service and any additional terms outlined by Google regarding the use of its APIs.

We use Google OAuth 2.0 to securely request access to your calendar and basic profile information. You can revoke this access at any time in your Google Account Settings.

3.2 Your Responsibilities

You are responsible for maintaining the confidentiality of any login credentials associated with your Google account. You agree to notify us immediately of any unauthorized use of your credentials or any other breach of security.


4. Prohibited Uses

You agree not to engage in any activity that:

  • Violates any applicable law, regulation, or third-party right.
  • Interferes with or disrupts the Service or any servers or networks connected to the Service.
  • Attempts to gain unauthorized access to our systems or the accounts of other users.
  • Involves the upload or transmission of viruses, malware, or any other harmful code.
  • Abuses, harasses, threatens, impersonates, or intimidates other users or third parties.
  • Exceeds reasonable request volume or otherwise places undue burden on our infrastructure.

5. Intellectual Property

All text, graphics, user interfaces, logos, and associated intellectual property on or related to the Service are owned, controlled, or licensed by us. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Device and Service solely for your personal, non-commercial purposes in compliance with these Terms.


6. Beta Release

The Service is currently released as a beta product to a limited audience. You acknowledge that the Service may contain bugs, experience service interruptions, or not function as intended. We reserve the right to modify, suspend, or discontinue certain features at any time without notice.


7. Disclaimer of Warranties

The Device and Service are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the accuracy, reliability, or availability of the Device or Service or any content therein.


8. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will we be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of, or inability to access or use, the Device or Service.
  • Any third-party conduct or content on the Service, including any defamatory, offensive, or illegal conduct of other users or third parties.
  • Any unauthorized access, use, or alteration of your data or content.

9. Indemnification

You agree to defend, indemnify, and hold harmless Timechief and John Morrice Developer, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; or (c) your violation of any third-party right, including without limitation any intellectual property, property, or privacy right.


10. Termination

We reserve the right, in our sole discretion, to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms or any applicable law or regulation.


11. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or legal requirements. We will notify you of any significant changes by posting the new Terms on our website or through the Device or Service. Your continued use of the Service after such postings constitutes your acceptance of the revised Terms.


12. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of Scotland. You agree that the courts of Scotland shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Service.
